1. Scope and Acceptance

These Terms & Conditions ("Terms") govern your use of https://esima.com and the purchase and use of eSIM data plans offered by Esima, a trading name of ESIMA LTD, a company registered in England and Wales under company number 15920080, with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ ("we", "us", "our"). By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2. Definitions

  • "eSIM" — An embedded SIM: a digital SIM profile installed on a compatible device that connects it to a mobile network without a physical SIM card
  • "Data Plan" / "Plan" — A prepaid allowance of mobile data for a specified destination (Local) or group of destinations (Regional) and validity period
  • "QR Code" — The activation code we deliver by email that you scan to install your eSIM profile
  • "Validity Period" — The window during which your data allowance can be used, starting as described in your plan
  • "Customer" / "You" — Any person who accesses our website or purchases a Plan

3. Nature of the Service

Esima is a reseller of travel eSIM data connectivity. Important characteristics of our service:

  • Data-only: Our plans provide mobile data only. They do not include voice calls or SMS unless explicitly stated for a specific plan. Data-based services (messaging apps, VoIP, email) work over the data connection
  • Digital delivery: No physical SIM is shipped. Your eSIM is delivered as a QR code and activation details by email, typically within minutes of payment
  • Network coverage: Connectivity is provided by our local mobile network partners at your destination. Coverage, speed, and available technology (4G/LTE, 5G where supported) depend on the partner network and local conditions

4. Device Compatibility (Your Responsibility)

An eSIM only works on an eSIM-compatible and carrier-unlocked device. Before purchasing, it is your responsibility to confirm that:

  • Your device supports eSIM (most recent iPhone, Samsung Galaxy, Google Pixel and other models do; some regional variants and older devices do not)
  • Your device is not carrier-locked to a specific mobile operator
  • Your device's software is up to date

We provide compatibility guidance on our website and in our Help Center. We are not responsible for an inability to use a Plan caused by an incompatible or carrier-locked device. Refunds for compatibility issues are addressed in our Refund & Replacement Policy.

5. Activation and Validity

  • Each Plan has a defined validity period, shown on the product page before purchase
  • Depending on the plan, validity begins either when the eSIM first connects to a network at the destination or on a stated activation date — the applicable rule is shown on the product page
  • Unused data does not roll over after the validity period expires, and remaining data has no cash value
  • You should install your eSIM before you travel, but only let it connect at your destination if your plan starts on first connection

6. Data Allowance and Fair Use

  • Plans are sold with a fixed data allowance (or, where offered, an "unlimited" allowance subject to a fair-use policy)
  • Once your allowance is consumed, your data connection stops until you purchase a new plan or top-up (where available)
  • "Unlimited" plans are subject to a fair use policy: to protect network quality for all users, speeds may be reduced after a high-usage threshold, and the service must not be used for tethering abuse, continuous high-bandwidth streaming, or commercial/server-grade usage
  • Our partner networks may prioritise or shape traffic in line with their own acceptable-use and fair-use rules

7. Acceptable Use

You agree not to use our service or any Plan to:

  • Engage in any unlawful, fraudulent, or abusive activity
  • Send spam, distribute malware, or carry out network attacks
  • Resell, sublicense, or commercially redistribute connectivity without our written authorisation
  • Circumvent fair-use limits, validity periods, or geographic restrictions of a Plan
  • Interfere with the security or integrity of our website, partner networks, or other users

We and our network partners may suspend or terminate connectivity that breaches these rules or applicable law.

8. Orders, Prices and Payment

  • A binding contract is formed when we send you an order confirmation containing your eSIM QR code and activation instructions
  • All prices are shown in the selected currency and include applicable taxes where required
  • Payments are processed securely through Stripe. We accept major cards and popular wallets such as Apple Pay and Google Pay
  • Prices may change without notice, but confirmed orders are honoured at the purchase price
  • We may refuse or cancel orders in cases of suspected fraud, pricing errors, or provisioning unavailability

Payment disputes: If a payment is reversed or charged back without valid cause and without first contacting our support team, we reserve the right to suspend the associated eSIM and account and to recover reasonable losses and administrative costs.

9. Delivery

Your eSIM is delivered digitally to the email address provided at checkout and is available in your account dashboard. Delivery is typically instant and is, in any case, fully automated 24/7. If you have not received your eSIM within 30 minutes, please check your spam/junk folder and then contact our support team.

10. Right of Withdrawal and Refunds

Because an eSIM is digital content supplied immediately, specific conditions apply to cancellation and refunds (including the EU/UK exception for digital content where performance has begun with your consent). Please refer to our Refund & Replacement Policy for full details on eligibility and how to request a refund.

11. Service Availability, Warranty and Liability

  • We take reasonable care to provide reliable connectivity, but we do not guarantee uninterrupted, error-free, or universally available coverage. Mobile networks are inherently subject to local outages, congestion, weather, terrain, and government action
  • If an eSIM is faulty or fails to provision through no fault of yours, we will provide a replacement or, where appropriate, a refund as set out in our Refund Policy
  • We are not responsible for issues caused by incompatible or locked devices, incorrect installation, exhausted data allowance, expired validity, or third-party apps and services
  • To the maximum extent permitted by law, our total liability for any claim shall not exceed the price you paid for the Plan in question, and we are not liable for indirect, incidental, or consequential losses

Statutory rights preserved: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law. The limitations above apply only to the extent permitted by the laws of your country of residence.

12. Intellectual Property

All content on the Esima website — including text, graphics, logos, and design — is the property of ESIMA LTD or its licensors and is protected by copyright and other intellectual-property laws. You may not copy or reuse it without permission.

13. Privacy

Your privacy matters to us. Please see our Privacy Policy for how we collect, use, and protect your personal data.

14. Governing Law and Dispute Resolution

We encourage you to contact our support team first — most issues are resolved quickly and informally. Nothing in these Terms affects the mandatory consumer-protection rights you have under the laws of your country of habitual residence. EU consumers may also use the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

15. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government action, network-operator failures, or disruptions to internet or mobile infrastructure.

16. Modifications to These Terms

We may update these Terms at any time. Changes will be posted on this page with a revised "Last updated" date, and material changes will be communicated by email or a prominent notice. Your continued use of our service after changes are posted constitutes acceptance of the revised Terms.

17. Severability and Entire Agreement

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect
  • These Terms, together with our Privacy Policy, Refund & Replacement Policy, and Cookie Policy, form the entire agreement between you and ESIMA LTD regarding our website and services
